The Workplace Relations Commission found Vytautas Germanavicius’s employment equality complaint against Brendan Smith t/a Smith Gala Express not well founded after Germanavicius failed to attend either hearing. The merits were not decided. In a decision dated 26 April 2022, Adjudication Officer Marguerite Buckley said she was satisfied he had been informed in writing of the hearing details. Germanavicius alleged he was denied statutory employment entitlements because he was Lithuanian. Smith disputed that he was an employee, saying he was self-employed.
