The Workplace Relations Commission rejected Desmond Murphy’s disability discrimination complaint against Road Safety Operations Ireland, T/A, Go Safe, in a decision dated 15 June 2022. Murphy said his employer refused a shift change he sought to attend a course and that he felt compelled to resign. The company denied discrimination and said it could not commit to the requested changes over an extended period. The adjudicator found Murphy had not established that he had a disability under the Employment Equality Acts. She said there was no evidence either condition limited his work performance, and the claim could not succeed.
