The Workplace Relations Commission awarded a security guard €270.86 in unpaid overtime after finding a security services provider had underpaid him. The WRC dated its decision 26 October 2021. The WRC found the guard was owed €72.81 for a full shift on 16 January 2020 and that he had been underpaid €250 in holiday pay because it was not calculated over the required 13-week period. It also awarded €34.95 for an annual leave pay shortfall and ordered the provider to comply with the Security Industry Employment Regulation Order. The WRC found that hours above 48 in a week were payable at the overtime rate under the guard’s weekly roster cycle. It awarded €270.86 based on his hours records because the provider had no contemporaneous working-time records. The guard’s claim for a separate €37.87 wage shortfall failed, as did his complaint about late holiday pay; the WRC found his leave began on 19 December 2019, after payment was made.
