The WRC recommended that a third-level college pay a worker €2,500 after finding she had been treated inflexibly over a temporary Grade VI role. In a recommendation dated 23 April 2021, Adjudication Officer Michael McEntee also recommended restoring her first-place rights for Grade VI positions until summer 2022.

The worker said the college improperly ended her specific-purpose contract and denied her promotion because of her grievances and an earlier WRC case. The adjudicator found major doubt about whether the vacancy was covered by the panel rules, but concluded that if they applied, the contract was not improperly ended. He found the evidence did not support the separate penalisation allegation.

The WRC also recommended that the college discuss internal promotion arrangements with staff unions, including FORSA, and seek help from the WRC Advisory Service.
