The Workplace Relations Commission found Jaroslaw Lukasiewicz’s dismissal by K-tech Security Unlimited Company was fair. The decision, dated 5 May 2022, also found his active working-time and minimum-notice complaints not well founded; three other complaints had been withdrawn. Lukasiewicz, a security guard, accepted that he had fallen asleep while on duty but argued his long, changing shifts contributed and dismissal was excessive. The company said the incident breached his duties and put client relationships at risk. The WRC found the disciplinary process adequate and the termination within the range of reasonable responses. It also accepted that Lukasiewicz had taken and signed for his breaks, and found no prima facie case in his night-worker complaint.
