WRC rejects Gerry Williams’s constructive dismissal complaint against Mahon’s Spar

The Workplace Relations Commission found that Gerry Williams was not unfairly dismissed by J.a.j. Supermarkets Limited Mahon's Spar Supermarket. The decision was dated 12 April 2022. Williams, a senior butcher, said changes to his duties and unreasonable requests led him to resign after the employer failed to address his grievances. The supermarket said the requests were reasonable in the context of financial losses. The adjudication officer found the changes were reasonable in that context and that the employer’s conduct did not breach the implied term of mutual trust and confidence. Williams had not established that he was dismissed in circumstances that amounted to constructive dismissal.
