The Workplace Relations Commission awarded Stephen Ng €34,560 after finding he was unfairly dismissed from his job at MCF Catering Limited Orchard Restaurant. The WRC also awarded him two weeks’ notice pay of €960 and four weeks’ remuneration for a failure to provide written employment terms, though it did not state a figure for that award.
The decision was dated 5 July 2022. The WRC found Ng had been summarily dismissed without a fair process and had not received notice or a contract setting out his employment terms. Ng said he worked 48 hours a week at €10 an hour and understood Moanne Chow to be his employer. MCF Catering said it had employed him only since 2018; Ng said his employment began in 2016.
Three complaints, including a minimum-wage complaint and two working-time complaints, were withdrawn. The decision gives findings on the employment-terms, unfair-dismissal and minimum-notice complaints, but does not give outcomes for the other complaints listed in the case.
