The Workplace Relations Commission ordered a county council to pay a retired depot assistant €9,744 after finding his overtime should count towards his pension. The decision was dated 27 June 2022.
The worker said he had worked regular overtime from 1997 to 2008, including evening and weekend shifts, and that the work was compulsory. The council argued it was voluntary and did not qualify for pension purposes.
The adjudicator found the overtime was consistent, regular, rostered and compulsory, formed part of the worker’s employment and could only be done outside normal hours. The decision found it met the criteria in Circular 12/91. The €9,744 payment covers the six-month period before the complaint was referred to the WRC.
