Caroline Noonan was awarded €4,000 compensation after the Workplace Relations Commission found she had been constructively dismissed from her bar-manager role at The Canal Turn. The WRC dated its decision 12 July 2022.
Noonan said she considered herself dismissed after a meeting in which Bridget Carey, trading as The Canal Turn, said her work would be closely supervised. Carey said Noonan had walked out and resigned. The WRC found Carey had not intended to dismiss Noonan at the meeting, but that Noonan acted reasonably in resigning after an unfair process. Noonan had no agreed procedure to raise her grievances, and Carey was unreasonable in failing to contact her after she left.
The WRC also awarded Noonan €550 for unpaid wages, €2,200 for failing to provide written employment terms, €440 for outstanding annual leave and a further €500 in compensation, and €1,100 for statutory notice. The respondent conceded the wage, terms and annual-leave complaints. The Sunday-work complaint was not well founded because neither of the two days Noonan worked in the relevant period was a Sunday.
