The Workplace Relations Commission found Maureen Lynch’s unfair dismissal complaint against the Health Service Executive HSE West was not well founded. The decision was dated 26 June 2024. Lynch worked as an agency multitask attendant assigned by Servisource to University Hospital Galway. She said she was sent home in June 2019 without an explanation, procedure or notice. The HSE argued she remained employed by Servisource and that ending its contract with the agency did not amount to a dismissal by the HSE. The WRC found that Lynch was never directly employed by the HSE and that the end of the agency contract affected all multitask attendants at the site. It concluded the HSE was not responsible for an individual dismissal in those circumstances.
