WRC has no jurisdiction over HAP discrimination complaint against landlord

By Donal Gilhooly

Historic decision · Decision date:

Place: no local area assigned from the source.

The Workplace Relations Commission found it had no jurisdiction to hear Selim Arafa’s complaint against landlord Mr Joseph Hughes over a delay in completing the landlord section of a Housing Assistance Payment form. Adjudication Officer Maire Mulcahy dated the decision 25 April 2022. The merits were not decided.

Arafa alleged Hughes delayed signing the form; Hughes said he would sign once the property was no longer used as a business address. He signed it on 10 October 2019. Arafa sought compensation and an apology.

The WRC found the required ES.1 form did not meet the statutory timing requirement, and no extension application had been made. It therefore found it had no jurisdiction to hear the complaint.
