The Workplace Relations Commission found Marian Mc Mahon’s complaint against the University of Limerick was brought outside the available time limit and was not well founded; the merits were not decided. The decision was dated 29 July 2022.
Mc Mahon, a student counsellor, sought annual leave and public holiday pay for earlier service after being treated as self-employed. She confirmed she had received all leave and public holiday entitlements due in the 12 months before filing. The adjudicator said the Organisation of Working Time Act complaint could cover no more than 12 months before filing. The adjudicator had no jurisdiction to decide the separate pension contribution issue.
