The Workplace Relations Commission found that Santa Tashfeen was not discriminated against by her landlords after they failed to complete forms for her Housing Assistance Payment application. The decision, dated 26 November 2021, said the complaint was not well founded.
Tashfeen said she became eligible for HAP in May 2019 and repeatedly asked the landlords, Catherine Hanly and Evan Curran, to complete the paperwork. The forms were not completed, and she lost the opportunity to receive up to 12 months of assistance. She later moved with her family to Mullingar, where another landlord accepted HAP.
Curran said he had intended to help and had no difficulty with the scheme, but he was not tax compliant. The adjudication officer found that a landlord seeking to take part in HAP had to be tax compliant, and concluded that this was why Curran could not assist Tashfeen. The officer found the failure was not because she was, or hoped to be, a HAP recipient. The complaint under the Equal Status Act was not well founded.
