The Workplace Relations Commission rejected an administrator’s constructive-dismissal claim against a college, finding that she had not raised a formal grievance before resigning or exhausted the available procedures. The decision was dated 14 July 2021.
The administrator alleged bullying, harassment and unfair treatment at work, and said these led her to resign. The college denied the claim, saying grievance procedures were available and that she had not raised a grievance before leaving.
The adjudication officer found that the first formal grievance was made after the resignation and that the administrator had not used the college’s grievance procedures or its Dignity at Work Policy. The officer also found that the college acted reasonably and its conduct did not leave her with no option but to resign. The constructive-dismissal claim was not well founded and failed.
