The Workplace Relations Commission found that landlord Maureen McDonagh did not discriminate against tenant Usman Safder over Housing Assistance Payment (HAP) paperwork. Adjudication Officer Louise Boyle dated the decision 18 October 2021.
Safder said McDonagh and her husband would not return signed HAP forms. He said her husband had told him to put rent of €1,200 on the form. McDonagh’s side said the actual monthly rent was €500 and the form was not signed because it showed the wrong amount. Evidence also showed that McDonagh accepted HAP at other properties.
Boyle preferred McDonagh’s account, finding the form was not signed because it recorded an incorrect rent. The WRC found Safder had not established discrimination on the housing assistance ground.
