The Workplace Relations Commission found it had no jurisdiction over Felix Toure’s race discrimination and victimisation complaint because it was referred outside the statutory time limit. The decision was dated 28 June 2022. The merits were not decided. Toure, a security officer assigned to a site in Grangecastle, alleged race discrimination over his working conditions, transfers and unsuccessful applications for screening supervisor roles. He also alleged victimisation over a transfer to Leopardstown. The employer denied the allegations and argued the complaint was out of time. The officer found the alleged incidents occurred in 2017 and 2018, and that no incident took place on the latest date Toure cited, 24 May 2019. The complaint was referred on 26 May 2019, so the WRC concluded it was outside the statutory time limit.
