The WRC dismissed two Equal Status complaints by Olumide Smith against The Employer of Mary Kelly as misconceived, finding it had no jurisdiction to hear claims about judicial decision-making and court proceedings. The decision was dated 11 November 2021; the merits were not decided.
Smith's complaints concerned a former case being struck out in his absence and being asked to leave seats reserved for parties in a High Court courtroom. The WRC found that judicial decisions and the related conduct of court proceedings were not a service or facility under the Equal Status Act.
