WRC grants senior developer redundancy payment after unusual layoff

The Workplace Relations Commission found that A Senior Developer was entitled to a redundancy payment from A Government Department after allowing his appeal against the rejection of his claim as out of time. The decision was dated 5 March 2020. Payment is subject to confirmation that he was in insurable employment during the relevant period. The adjudication officer said the complainant had been placed on temporary layoff in February 2016 and remained in contact with his employer’s chief executive, doing some work until March 2017. The officer found that the company had not clearly identified who was responsible for the business or given him dismissal notice or a redundancy certificate. That uncertainty justified starting the 104-week claim period on 25 March 2017. The decision states that €600 of his €1,211.54 gross weekly pay was reckonable in calculating the payment.
