The Workplace Relations Commission found that a financial institution fairly dismissed an employee who failed to disclose serious financial difficulties in declarations required for his role. The decision was dated 20 February 2019.
The employee had worked for the institution since 2014 and earned €36,000 a year. The institution said his debts exceeded €400,000 and that inaccurate declarations breached the trust required in a regulated role. He argued that he believed his earlier declaration was compliant and that dismissal was too harsh, saying it would effectively end his financial-services career.
The adjudicator found that the employee’s failure to make the required disclosures provided significant grounds for disciplinary action. The disciplinary process did not breach his rights, and the institution’s decision fell within the range of reasonable responses. The dismissal was fair and the unfair dismissal complaint was dismissed.
