The Workplace Relations Commission rejected Aoife Nadia Martin’s gender discrimination complaint against Home Fare Services t/a KSG over a trial day for a kitchen job. Adjudication Officer Jim Dolan dated the decision 17 May 2018.

Martin said the dining manager told her he would not hire her because two women could not work in the kitchen where heavy lifting was involved. Home Fare Services denied making that comment and said no suitable vacancy was available after the trial day.

The WRC accepted that a conversation took place but found its content was disputed and there were no witnesses to corroborate the discrimination allegation. It concluded Martin had not established an initial case of discrimination, so the complaint failed.
