A chef manager’s race discrimination complaint against a company was not well founded, the WRC decided. Adjudication Officer Orla Jones dated the decision 6 June 2018.
The worker said his manager bullied him, criticised his work and English, and dismissed him because he was Romanian. A company said it raised performance concerns during probation, offered refresher training and put performance improvement plans in place. The worker had started on a six-month probationary contract, which was extended by three months.
The WRC considered whether the worker was treated less favourably because of race. It found the performance concerns had been raised with him and that he had opportunities to improve through training and performance plans. The adjudicator also noted the parties agreed the probation extension was intended to give him time to improve before the company decided to dismiss him for performance issues. The WRC found no evidence that the treatment was because of race and concluded that the worker was not discriminated against.
