WRC awards consultant €3,533.30 over withheld final salary

Workplace Relations Commission ·

A consultant was awarded €3,533.30 net after a recruitment company withheld his final four weeks’ salary to recover commission and bonus payments. The WRC found the deduction unlawful under the Payment of Wages Act in a decision dated 3 April 2018. The consultant said he had worked his agreed notice but was not paid. The company argued that commission, a bonus, payments relating to earlier commission and a telephone bill were repayable under his contract. The adjudicator found no term in the contract or emails authorising the deductions. The consultant had not received advance written details of a contractual deduction or a week’s notice. The company was directed to pay the compensation within 42 days.
