WRC awards security manager €32,500 for unfair dismissal

Workplace Relations Commission ·

The Workplace Relations Commission awarded a security manager €32,500 for unfair dismissal after finding his redundancy selection was neither transparent nor fair. The decision was dated 14 May 2018. The WRC also ordered payments for annual leave, working-time breaches, public holidays, unpaid wages and notice.

The adjudicator found the manager had not been consulted about alternatives, given a chance to influence the decision or offered representation. The night club advertised for security staff four days after his dismissal but did not inform him of or consider him for the role. He was out of work for more than 13 weeks before finding lower-paid work, and had to relocate with his family.

The WRC ordered €4,770 for annual leave, €2,000 compensation for a working-time breach, €800 for four public holidays, €2,608 in unpaid wages and €2,000 for two weeks’ notice. It dismissed the redundancy payment complaint because he could not receive statutory redundancy compensation as well as compensation for unfair dismissal.
