WRC finds it had no jurisdiction over chef’s three transfer complaints

By Cathal Brosnan

Workplace Relations Commission ·

The WRC found it had no jurisdiction over three complaints brought by a chef against a facilities management company after his employment transferred to a new provider. The merits were not decided. The decision was dated 26 April 2018. The chef said the former employer’s consultation about the transfer was inadequate and that failures around the transfer affected his terms and contributed to his later dismissal by the new employer. The WRC found that liabilities under his employment contract passed to the new provider on the transfer date, so the complaints against the former employer could not be pursued under the transfer regulations.
