WRC finds agency worker’s commuter ticket complaint not well founded

By Orla Quinn

Workplace Relations Commission ·

The WRC found that an agency worker’s complaint about not receiving a commuter travel ticket was not well founded. The decision was dated 23 March 2018. The worker argued that the hirer’s monthly ticket policy for fixed-term staff should also cover her. The employment agency said her €50,000 salary included compensation for benefits and exceeded the pay of comparable direct hires. The adjudication officer treated the ticket as a benefit rather than pay under the relevant agency-worker legislation and accepted that the worker’s enhanced salary meant she was not treated less favourably.
