WRC awards €3,147.61 after finding operative was unfairly dismissed

Workplace Relations Commission ·

The WRC found that a general operative was unfairly dismissed by a meat processing plant and awarded him €3,147.61 in compensation. The decision was dated 15 May 2018. The operative had worked at the plant since 2011. He said he refused an instruction to clear work at other stations after finishing his own work. The plant said the refusal amounted to gross misconduct and that he already had a final written warning. The WRC found there were grounds to begin disciplinary proceedings and that the process was generally fair, although the suspension decision was made before he could explain what happened. It found his refusal was not serious enough to justify dismissal and that the dismissal was outside the range of reasonable responses. The WRC found he contributed 60% to the situation. His separate employment equality complaint was withdrawn.
