The Workplace Relations Commission awarded a beauty therapist €7,500 after finding her dismissal unfair because her employer had not shown that a redundancy situation existed. The decision was dated 21 June 2018.
The therapist said managers told her the business no longer wanted its beauty service and gave her notice to finish. She said she could not afford the offer to take over that part of the business. The employer said the beauty side was running at a loss and offered her the chance to run it herself.
The officer noted that the employer provided no accounts to support its claim of losses. He also considered evidence that a former colleague was carrying out the beauty therapist role after she left. The three redundancy complaints were not well founded: the first because no redundancy situation existed, and the other two because they duplicated that claim.
