The Workplace Relations Commission awarded a machine operator €1,218.88 after finding a food company wrongly withheld sick pay. Adjudication Officer Patsy Doyle dated the decision 26 January 2018. The company said its occupational health assessment found no defined medical condition and that its scheme allowed discretion over sick pay. The officer found the company’s use of the report to stop payment went beyond the policy terms and that the worker had a contractual entitlement to sick pay. The related Industrial Relations dispute failed because the same facts had already been adjudicated and the issue had not been raised as a grievance.
