The Workplace Relations Commission dismissed Olumide Smith’s Equal Status complaint against The President of the High Court, The Hon. Mr. Justice Peter Kelly, finding it had no jurisdiction to investigate the case. The decision was dated 8 October 2021; the merits were not decided. Smith’s complaint concerned allegations about another judge’s conduct during High Court proceedings. The WRC found that Kelly had no involvement in those proceedings. The WRC found that judicial decision-making was not a service under the Equal Status Act. It considered the complaint misconceived and not properly before it, and dismissed it.
