WRC dismisses three Equal Status complaints against High Court judge

The Workplace Relations Commission dismissed three Equal Status complaints by Olumide Smith against The Hon. Mr. Justice Seamus Noonan, finding it had no jurisdiction to investigate them. The decision was dated 8 October 2021. Smith alleged racist harassment, discrimination and victimisation during High Court proceedings, and criticised the judge’s handling of hearings and decisions. The WRC found the complaints concerned court proceedings, which did not constitute a service under the Equal Status Act, and that judicial decision-making was immune from suit.
