WRC finds shop discriminatorily dismissed worker, awards €6,500

By Cathal Brosnan

Workplace Relations Commission ·

The Workplace Relations Commission found that a shop discriminatorily dismissed a worker on the disability ground and awarded him €6,500. The decision was dated 17 January 2018.

The worker said he told a trainee manager about his disability about a week before he was dismissed. The shop said it dismissed him over performance issues and had not known about the disability.

The adjudication officer found the trainee manager had been told, rejected the respondent witnesses’ account as not credible and found the shop had not considered measures that could have helped the worker remain in his job. The complaint was amended at the hearing from an Equal Status Act complaint to one under the Employment Equality Acts. The award represented a year’s salary.
