The WRC ordered a food take away to pay a general operative €166.50, less statutory deductions, for 18 hours worked during trial shifts. The decision, dated 4 October 2017, found that workers must be paid for hours worked even when an employer is assessing their suitability.
The worker completed three shifts over 9, 10 and 11 May 2017. The take away said it paid only workers it considered suitable and offered to pay for 10 hours as a gesture. The WRC found the worker was entitled to wages for all 18 hours.
