The WRC found that a pub or restaurant unfairly dismissed a chef and awarded him €1,500. Adjudication Officer Pat Brady dated the decision 15 February 2018. The respondent said the chef had agreed to leave after performance concerns. He denied agreeing to resign and said he had been dismissed. The officer found there had been an understanding that he would leave, but that the respondent applied pressure when the time came and failed to prove the termination was consensual. In setting the award, the officer took account of the chef’s conduct and evidence he found untrue and lacking in credibility as mitigating factors.
