A Spanish language assistant’s claim for a permanent contract was not well founded, the WRC ruled in a decision dated 14 February 2018. The assistant had worked under successive fixed-term contracts at a third-level education institution since September 2013, after an academic-year break. The adjudicator found that the strongest case was for three years and eight months of unbroken service, below the four years required for a contract of indefinite duration. The adjudicator considered the institution’s written explanation for using fixed-term contracts vague, but the complainant did not pursue that point. The claim failed because the required service threshold had not been reached.
