A WRC adjudication officer awarded a Service Adviser €12,000 for unfair dismissal and €1,500 for the company’s failure to provide written employment terms. The decision was dated 16 February 2018.
The officer found the dismissal lacked basic fair procedures and that the worker had been in an unsupportive work environment. The absence of procedures contributed to his failure to challenge performance concerns. The company cited performance and attendance problems and alleged that he misled it about customer debts. The officer accepted that performance difficulties contributed to the dismissal and took this into account when setting compensation.
The officer also upheld the minimum-notice complaint and required the company to pay one week’s notice. The worker withdrew his working-time complaint at the hearing. The compensation and notice payments were due within 42 days of the decision.
