The Workplace Relations Commission awarded €16,000 to a manager at a fast food outlet after finding his dismissal unfair. The decision was dated 30 January 2018. The WRC found that the employer had not investigated its concerns about the manager or given him a fair chance to respond.
The manager said he was removed from the roster and dismissed after raising concerns about staff annual leave. The outlet said management difficulties and attendance issues justified ending his employment. The WRC found those concerns were unsupported assertions and that the employer had not warned him his job was at risk.
The WRC found no substantial grounds justified the dismissal and that the manager was denied fair procedures and the right to be heard. It found reinstatement or re-engagement impractical and ordered compensation, including an element for prospective loss. The decision also noted the absence of employment documents and encouraged the employer to improve its contracts, policies and procedures.
