The Workplace Relations Commission rejected a restaurant employee’s constructive-dismissal and gender and disability discrimination complaints, and dismissed her public-holiday complaint as out of time. The decision was dated 5 April 2018. The public-holiday complaint was brought outside the time limit and was not well founded; the merits of that complaint were not decided. The employee said she was excluded from refurbishment work and that the restaurant mishandled her grievance. The adjudication officer found that the employer’s three-month delay in dealing with it was unacceptable, but also found that the employee unreasonably refused to meet management and insisted on an external mediator. The officer concluded that the employer’s conduct did not justify her resignation. The discrimination complaints also failed.
