WRC awards engineer €1,730.77 over missing written terms

By Ruairí Dolan

Workplace Relations Commission ·

The WRC awarded an engineer €1,730.77 after an engineering consultancy failed to provide written employment terms. The decision, dated 28 September 2017, also found that payment equivalent to 2.33 days’ pay for untaken annual leave remained due. The amount was not specified. The engineer’s complaints concerned missing written terms, unpaid overtime and working hours. He claimed €129,484 in unpaid wages and €9,449 in holiday pay. The officer found no contractual right to overtime and no overtime worked or claimed during the period considered. The written-terms complaint succeeded; the overtime complaint and both working-hours complaints failed. The employer accepted that it had not provided a contract.
