The Workplace Relations Commission awarded a chef €6,500 for unfair dismissal and €1,230 in notice pay after finding that a restaurant had ended his employment unfairly. The decision was dated 20 March 2018. The chef said he had not resigned, but was dismissed after a dispute over sending a kitchen porter home. The restaurant argued he had walked out and resigned. The adjudicator accepted the chef’s account, finding that packing his knives did not clearly communicate a resignation and that he returned to work the next day. The dismissal was substantively and procedurally unfair; a meeting to consider reinstatement focused on performance issues and did not follow fair procedures. The WRC also found the minimum notice complaint well founded and awarded two weeks’ pay. The chef’s complaint about written employment terms was not well founded: the adjudicator was satisfied a statement had been provided, although it had not been updated to reflect his head chef role.
