WRC awards agency worker €8,958 for unfair dismissal

By Donal Gilhooly

Workplace Relations Commission ·

The WRC awarded an agency worker €8,958 after finding that a global services company unfairly ended his assignment. In a decision dated 12 December 2017, Adjudication Officer Marian Duffy found the company was the correct respondent and that the worker was dismissed without warning or fair procedures. The company said the worker remained employed and paid by the agency after his assignment ended, and that it acted over his conduct and performance. Duffy found there were no substantial grounds for dismissal and that the company had not given him a chance to respond or appeal. The award reflected five and a half months’ lost earnings. Duffy reduced the compensation by three months’ remuneration because the worker did not take a bank job offered by the agency.
