WRC awards cleaner annual leave and public-holiday payments

By Rory Hanlon

Workplace Relations Commission ·

A cleaner won two working-time complaints against a recruitment company over annual leave and public-holiday entitlements. The WRC decision was dated 14 November 2017. The WRC directed the employer to pay €623.66 for accrued annual leave and €73.20 for an October 2016 public holiday, along with €100 compensation for each complaint. The cleaner had been on maternity leave and said she had not received all her accrued entitlements. The adjudicator found that annual-leave and public-holiday rights continued during maternity leave. The annual-leave complaint was well founded; the public-holiday complaint was well founded in part because only the October holiday fell within the period covered by the complaint.
