WRC rejects manager’s pension discrimination and contract claims

By Niamh Kearney

Workplace Relations Commission ·

The WRC found no age discrimination in a senior manager’s complaint about changes to his pension terms and rejected his claim for a written statement of employment terms. Adjudication Officer Orla Jones dated the decision 21 September 2017. The worker said the enhanced transfer value offered for moving accrued defined-benefit pension rights into a defined-contribution scheme disadvantaged employees aged 55 to 59. The company said the offer was optional, he had independent financial advice, and the sliding scale reflected differences in statutory transfer values. The WRC found he had not established facts supporting an inference of age discrimination. On the employment-terms complaint, he agreed he had received an appointment letter when he started work, and the officer found he could have requested a statutory statement. Both complaints were not well founded.
