WRC could not hear restaurant worker’s four claims against former director

By Eimear Byrne

Workplace Relations Commission ·

The WRC did not uphold four claims by a restaurant worker against a former director of the dissolved company that had employed the worker. The decision was dated 14 September 2017; the merits were not decided. The claims concerned redundancy, minimum notice, employment information and working time. The adjudication officer said the former director had no personal liability for the company’s debts and the WRC had no jurisdiction to hear the complaints. The former directors agreed to support the workers’ application to the Social Insurance Fund.
