The Workplace Relations Commission found the dismissal of an accounts and purchasing administrator procedurally unfair and awarded her €5,000 in compensation. The decision, by Adjudication Officer Eugene Hanly, was dated 19 January 2018. The retail employer said financial difficulties led it to close its distribution section and reduce four front-office roles to two. Staff could apply for the remaining posts, but the administrator was unsuccessful. She argued there had been too little consultation, no exploration of alternatives, unclear selection criteria and no right of appeal. The WRC accepted that the redundancy was genuine, but found that the employer had not allowed enough time for consultation or explored alternatives. It also found that the selection criteria were not explained in advance, no appeal was offered, and it was inappropriate to include a manager with whom she had known issues on the selection panel. The dismissal was unfair on procedural grounds.
