WRC rejects truck driver’s notice and redundancy claims

By Fionn Kelly

Workplace Relations Commission ·

The WRC rejected a truck driver’s claims for minimum notice and statutory redundancy, finding that he resigned and his job was not redundant. The decision was dated 25 January 2018. The adjudicator found that the driver was not entitled to notice because his employer had not terminated his employment. He had rejected five alternative roles, and vacancies remained. The company had paid him €1,500 as a goodwill payment, along with two weeks’ pay in lieu of notice and outstanding holiday pay.
