A factory operative was awarded €2,483.96 after the Workplace Relations Commission found he was unfairly dismissed over a procedural breach. In a decision dated 15 March 2018, the WRC said his employer should have provided the documents behind its decision to terminate his employment so he could understand the case and appeal. The operative had worked for the employer since 2001 and had been absent for an extended period. The employer said it kept his role open for two years, arranged medical assessments and found no suitable alternative role. It relied on frustration of contract and the fact that he did not appeal the dismissal. The WRC accepted that the employer faced a difficult situation but found the operative was not given the information needed to be heard and appeal. The award was four weeks’ gross pay.
