The WRC recommended cutting a hospital supervisor’s temporary transfer to day shifts from three months to six weeks, with a formal review after four weeks. The recommendation was dated 29 September 2017. The worker, an admin supervisor at a large Dublin hospital, challenged disciplinary sanctions and the hospital’s handling of her complaint. She said the investigation went beyond its terms of reference and breached fair procedures. The hospital said it had acted fairly and that the warning and transfer were proportionate. The adjudication officer found that the hospital had acted fairly in the disciplinary process and that including later events in the investigation was allowed under its procedures. The officer also found that the day-shift requirement affected the worker’s family life and was punitive. The recommendation shortened the transfer period; the written warning was unchanged.
