WRC finds Revenue Protection Officer was fairly dismissed

By Rory Hanlon

Workplace Relations Commission ·

The WRC found that a public transport provider fairly dismissed a Revenue Protection Officer after finding he claimed sick pay while fit to work and used weights and a treadmill. The decision was dated 28 September 2017. The employer said it dismissed him for gross misconduct after an investigation into abuse of its sick pay scheme. He denied using weights and running at the gym, and argued that dismissal was too severe and that he had not been told trust and confidence was at issue. The officer found the employer had a genuine basis for its misconduct finding and had followed fair procedures, including giving him representation and two appeal hearings. His unfair dismissal complaint failed.
