WRC awards sales assistant €500 over missed rest breaks

Workplace Relations Commission ·

The WRC awarded a sales assistant €500 after finding that a retailer and fuel station failed to prove it provided required 15-minute rest breaks. The employee said single-person staffing made it impossible to take breaks during shifts longer than four and a half hours. The employer said breaks were taken but not recorded. In a decision dated 27 November 2017, Adjudication Officer Louise Boyle extended the time limit, finding reasonable cause linked to a grievance and the respondent’s failure to proceed to conciliation. The employer had not kept records of breaks and working time, so it had to prove compliance. The officer found it had not done so.
