WRC finds order packer was not unfairly dismissed after lengthy absence

By Fionn Kelly

Workplace Relations Commission ·

The Workplace Relations Commission found that an order packer was not unfairly dismissed after more than four years away from work. The decision was dated 29 January 2018. The worker’s union argued that the employer acted unreasonably and sought her reinstatement. The employer said occupational health advice found her unfit for her usual duties, and that it had invited her to meetings and requested evidence of fitness to return. The adjudication officer found that the employer was willing to facilitate her return if she attended a final medical assessment. The worker repeatedly failed to attend arranged meetings or provide a satisfactory explanation, and did not provide the requested fitness certificate. The officer found that asking for the certificate was reasonable. The complaint failed on its merits.
